Contract and official language

The last entry is la clause attributive de juridiction, and the noun in the middle of it is the costliest false friend in legal French. In English « jurisdiction » is an abstraction. It is the authority a body holds, or the territory and the legal system over which that authority runs, as in « the courts of this jurisdiction » or « the matter falls outside our jurisdiction ». French has that sense too, and it is the lesser of the two. Une juridiction is a court. It is countable, it has a building and a president, and its plural is entirely ordinary: les juridictions administratives are the administrative courts, la juridiction compétente is the court with authority to hear the case, and la plus haute juridiction is the highest court in the land. So the clause named in this entry does not allocate a legal system to the contract; it names the court the parties have agreed to go to, which is why the example sentence can end on le tribunal de commerce without changing the subject. Read « jurisdiction » there and the sentence loses the one thing it settles.
