La contestazione disciplinare is the entry an English reader is most likely to file on the wrong side of the desk. The word looks like « contestation », and everything « contest » does in English points one way: to dispute, to challenge, to refuse to accept. So la contestazione reads as the employee’s objection. It is the reverse. In the language of Italian employment, contestare takes a thing and puts it to a person as a charge — contestare un addebito, contestare i fatti al dipendente — and the noun names the employer’s written statement of what the worker is said to have done. It comes first; the reply comes afterwards and has a name of its own, le giustificazioni. What keeps the trap alive is that the disputing sense survives elsewhere: contestare una multa really is to challenge a fine, and la contestazione of the late sixties was a protest movement. Only the setting decides the direction. The reliable test is the second person in the sentence: wherever contestare is followed by a qualcuno, an accusation is being served, and the reader named in it is the one answering.
